Selling an inherited house isn't like a typical listing. A personal representative has to be appointed before anything can be signed, heirs are often scattered across the country, and your family may be working through loss and paperwork at the same time.

Before I was a REALTOR®, I was an attorney with a focus on estate matters, and I've guided families through exactly this kind of sale in Bloomington, Bedford, and south-central Indiana since 2001.

Do I have to open probate before I can sell an inherited house in Indiana?

In most cases, yes — if the property was in the deceased's name alone, an estate has to be opened and a personal representative appointed before a sale can close, since the paperwork has to catch up to the house before a title company will sign off. There are exceptions: if the property was held in a trust, passed through a transfer-on-death deed, or you owned it jointly with a right of survivorship, you may be able to sell without opening probate at all. If you're not sure which situation applies to you, that's a normal place to be — it's usually the first thing I help sort out with clients, often before we've even talked about the house itself.

Can I list the house before probate closes?

Yes, usually. Probate closing and the house selling are typically two separate timelines, not one that has to finish before the other starts. Once a personal representative has been appointed — and sometimes with specific court authority, depending on how the estate is set up — the house can generally be listed, shown, and even go under contract while probate is still open. The closing itself gets timed around the legal side, not the other way around.

Should I take a cash offer instead of listing the house?

Not necessarily — but it's worth comparing before you decide. Cash-buyer offers aren't a scam; a cash sale really can close in a couple of weeks with no repairs and no showings, and for the right situation that's worth something. What those offers almost never include is a real number to compare against. I can give you a second number — what I'd expect the house to sell for listed, minus commission and typical closing costs — side by side with a cash offer, so it's an informed choice instead of a rushed one.

What do we do with everything inside the house?

This part is usually harder than the real estate side. Deciding what to do with a lifetime of belongings — often with siblings weighing in from different states — rarely has a clean answer, but there are people who make it easier: estate sale companies, donation pickup services, respectful junk removal crews, and appraisers for anything worth setting aside first. I keep a short list of people in the Bloomington area I trust for exactly this, and I'm glad to share it whether or not we ever talk about the house itself.

Can this be handled if I live out of state, or if an attorney is already involved?

Yes to both. If you're not local, settling an Indiana estate from a distance is genuinely one of the harder versions of this, and it's a large share of who I work with — video walkthroughs, coordinating repairs or cleanout crews on your behalf, and being a single point of contact so you're not fielding calls all week. And if an attorney is already handling the estate, that's a good thing, not a complication — my own background is as an estate attorney before I became a broker, so I know what stays in their lane, what's mine, and how to keep the two moving together.

How long does this whole process usually take?

It varies, but Indiana estates often take six months to a year to fully settle, and most of that time is quiet on purpose — waiting on the court, waiting on creditors' claims to run, waiting on family to be ready. That doesn't mean nothing can happen with the house in the meantime. There's no set clock you're failing to meet; it's normal for this to take time, and I'm glad to answer a question or check in whenever it's useful, not just when you're ready to list.

What if the heirs don't agree on whether to sell?

It happens in most estates, not just complicated ones. What usually unlocks it isn't more discussion — it's information: an honest valuation and a clear picture of what it costs to keep the house the longer a decision gets delayed, between taxes, insurance, and upkeep. I've helped facilitate these conversations before, and I'm glad to help with yours.
